House Judiciary Postpones Pistol Brace Rule Markup After Nashville Shooting
The House Judiciary Committee postponed a scheduled Tuesday markup on a resolution to nullify a Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) pistol brace rule following the mass shooting at a Nashville, Tennessee, school on Monday.
“Democrats were going to turn this tragic event into a political thing,” Judiciary Committee Chair Jim Jordan (R-Ohio) told The Hill on Monday evening.

Congressional Witness Admits Bloomberg Gun Control Group Asked ATF for Pistol Brace Rule
Rep. Jim Jordan (R-OH) questioned Everytown for Gun Safety’s federal legal director Rob Wilcox during Thursday’s House Judiciary Committee hearing and learned that the Bloomberg-affiliated gun control group actually asked the ATF to take action on pistol stabilizer braces.
Jordan asked Wilcox, “Did you or anyone in your organization communicate with the ATF or the Biden administration about these issues we are discussing today, prior to the notice of proposed rulemaking?”
Wilcox responded, “We submitted a formal petition for rulemaking through the formal channel, sir.”
Jordan then pressed for certainty, asking, “Before the notice of proposed rule making?”
Wilcox responded, “That’s correct.”

Amicus Brief Filed Challenging ATF Pistol Brace Rule
Republican Tennessee Sen. Marsha Blackburn filed an amicus brief that states the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) new pistol brace rule infringes on the Second Amendment.
The Daily Caller first obtained the briefing, which was officially filed Feb. 27 in the United States District Court for the District of North Dakota. Blackburn was joined by thirteen Republican Senators and dozens of House Republicans to fight the ATF after they enacted a rule that would make pistol stabilizing braces illegal for anyone without a certain license.
The rule would make gun owners face the possibility of being charged with a felony if they do not register their firearms with the stabilizing braces.
In the amicus brief, the lawmakers contend that the rule was never authorized by Congress and violates separation of powers principles.
Everytown Loses Again
It should come as no surprise that anti-Second Amendment activists will do and say anything to push their agenda, including using tragedy to further their cause. Following a 2018 shooting in Santa Fe, Texas, the activists at Everytown Law saw an opportunity to do just that. The Michael Bloomberg-funded group spearheaded a lawsuit against Lucky Gunner with one clear goal: to drive us out of business. They failed. This week, we announce the dismissal and settlement of that lawsuit.
We spent three years vigorously defending against this lawsuit and the many false allegations levied against our company and its employees. We refused to back down and were committed to fighting as long as necessary to prove we did nothing wrong.

(Possible) Preventable Tragedy
Michigan Democrats are pushing for new gun control laws after three Michigan State University students were gunned down and several others were injured in a shooting Monday evening.
It is unclear whether additional laws will be any more effective than the existing gun laws that a Democratic district attorney failed to faithfully apply in full to the MSU shooter after his previous run-in with the law.
Former Ingham County District Attorney Carol Siemon not only pushed for Anthony McRae to avoid serious consequences and reacquire a weapon, but a general policy for other criminals as well.

H.R.374 (Abolish The ATF) Introduced
Rep. Matt Gaetz, R-Fla., introduced a bill to eliminate the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) following a controversial ruling that tightens regulations on pistol stabilizing braces.
The ATF issued its final rule Friday that will treat guns with stabilizing accessories like short-barreled rifles, which require a federal license to own under the National Firearms Act.
Attorney General Merrick Garland said the ruling enhances public safety, but Gaetz said it unfairly punishes disabled gun owners and veterans who rely on stabilizing braces to be able to fire with one hand.
Gaetz introduced H.R.374, the “Abolish the ATF Act,” Tuesday morning in response to the ruling, telling Fox News Digital it was the “final straw.”

US Appeals Court Blocks Bump Stock Ban
A Trump administration ban on bump stocks — devices that enable a shooter to rapidly fire multiple rounds from semi-automatic weapons after an initial trigger pull — was struck down Friday by a federal appeals court in New Orleans.
The ban was instituted after a gunman perched in a high-rise hotel using bump stock-equipped weapons massacred dozens of people in Las Vegas in 2017. Gun rights advocates have challenged it in multiple courts. The 13-3 ruling at the 5th U.S. Circuit Court of appeals is the latest on the issue, which is likely to be decided at the Supreme Court.

NY Supreme Court: Red Flag Law Unconstitutional
The New York law that enables the confiscation of guns from people who haven’t committed a crime is unconstitutional, a state Supreme Court judge has ruled.
This red flag law, or the Extreme Risk Protection Order law, lets individuals—including police officers—petition a court to allow the seizure of firearms from a person they believe poses a threat to themselves or others.
If a judge agrees, the judge can direct law enforcement to take guns from the person in question.
The law, which took effect in 2019, has led to the issuance of more than 1,900 removal orders.
However, the law is in violation of the U.S. Constitution’s Second and 14th amendments because it doesn’t “sufficiently protect a citizen’s rights,” state Supreme Court Judge Thomas Moran said in a ruling in late December 2022.

Half of the states in the U.S. no longer require residents to hold a concealed carry permit to carry firearms in public after Alabama, Indiana, Georgia and Ohio passed laws in 2022 removing permit requirements.
On Monday, Alabama began enforcing its permitless carry law, becoming the 25th state to do so, while Indiana, Georgia and Ohio also passed laws this year allowing residents to concealed carry firearms without a permit. Over the last two years 10 states have moved to permitless carry, including Utah, Montana, Iowa, Tennessee, Arkansas and Texas.
“Unlike states who are doing everything in their power to make it harder for law-abiding citizens, Alabama is reaffirming our commitment to defending our Second Amendment rights,” Republican Alabama Gov. Kay Ivey said in a statement after signing the bill into law. “I have always stood up for the rights of law-abiding gun owners, and I am proud to do that again today.”
