Beyond Stand Your Ground: Second Amendment Immunity Defense is the Next Legal Frontier

Wed, 03/16/2022 - 12:00

By Lee Williams . . .

Florida’s Stand Your Ground statute and similar laws in other states can offer immunity from prosecution when someone uses deadly force to defend themselves, and affords them quick access to an appellate review if the case doesn’t go their way.

In other words, if a defendant involved in a defensive shooting invokes a Stand Your Ground defense, their case can be dismissed before a trial even begins if it is proven they are entitled to statutory immunity, or appellate judges can be brought in quickly to make sure the case gets handled correctly.

Constitutional Carry Marches On: Indiana Permitless Carry Bill on Governor Eric Holcomb’s Desk

Wed, 03/16/2022 - 10:00

Last year was a banner year for constitutional carry in the U.S. Four states — Iowa, Montana, Tennessee and Texas — became permitless carry states in 2021. So far 2022 has seen plenty of progress, too. The club has expanded by two so far, with Alabama and Ohio deciding that citizens no longer need government-issued permission slips to bear arms.

Last week, the Indiana legislature put the finishing touches on House Bill 1296 which .

Democrats: We’d Rather Abandon the Country Than Take Up Arms to Defend It

Tue, 03/15/2022 - 14:00

By Larry Keane

Halfway around the world, Ukrainians are exhibiting bravery and courage in the face of an invading Russian army.

Meanwhile here in America, the political party that supports disarming and restricting the Second Amendment rights of their country’s law-abiding citizens, and that pushes to defund law enforcement, would turn and flee if their country were invaded.

A majority of self-described Democrats — 52 percent — say they would leave the United States if America were being invaded rather than stay and fight.

Florida Constitutional Carry Dies for Third Consecutive Year Under Republican Leadership

Tue, 03/15/2022 - 10:00

For the third year in a row, constitutional carry has died under Florida’s Republican supermajority control of the state’s legislature.

Sadly, the state no longer deserves the “Gunshine State” nickname. Rather, the entire state should be called “Disney World”. Why? Because a lot of make-believe is created and sold within the borders by lawmakers. The legislative leadership advertises itself as being pro-freedom and pro-gun. Yet, time and time again, they show that isn’t the case.

Governor Mike DeWine Signs S.B. 215 Making Ohio the 23rd Constitutional Carry State

Mon, 03/14/2022 - 20:39

The fact that Alabama Governor Kay Ivey affixed her signature to a bill last week making the Yellowhammer State the 22nd to make permitless carry the law shouldn’t really have shocked anyone. But today’s news that Governor Mike DeWine has made Ohio number 23 is a surprise to many who genuinely weren’t sure where he’d come down on the constitutional carry question.

As you can imagine, the news wasn’t taken well by our friends in the Civilian Disarmament Industrial Complex.

Mon, 03/14/2022 - 10:00

A Georgia high school coach is facing suspension after going hands-on with a female student with a gun in her backpack. Supporters say he saved lives, but the video tells a slightly different story.

Citing a violation of staff policies, the district initially terminated Tri-Cities High School Athletic Director Kenneth Miller, but later reversed course and suspended him in part because of an outcry from parents and the community in support of Coach Miller.

You Know Who Else Wears Masks? [VIDEO]

Sun, 03/13/2022 - 16:00

Illinois residents along with other deep blue states have faced mask mandates for almost two years now. Obviously compliance has varied widely by geography and by location. It’s also evolved into furious virtue signaling by some.

One group who eagerly embraced masks didn’t really care about any purported health benefits of masking or virtue signaling. And now that almost all of the mandates have been dropped by politicians who can see which way the political winds are blowing, things have changed.

Cracking Down On Legal Sales of Firearms Online

Sun, 03/13/2022 - 08:00

“Our bill would make it clear that it’s a crime to circumvent a website’s terms of service to sell a firearm.”

— Senator Diane Feinstein (D, CA)

This is ridiculous. One minute social media companies “are private companies and can do what they want,” etc. etc., and the next minute violating their terms of service is a Federal crime?

Let me just add that the social media companies don’t even follow their own dang terms of service.

THE NATION: There’s No Second Amendment on the South Side of Chicago

Sat, 03/12/2022 - 16:00

I have been close to gun violence my entire life. Growing up on the South Side of Chicago, I’ve seen my classmates carry firearms to keep themselves and their families safe from harm. And I later represented some of those same individuals in court—being prosecuted for firearm possession—when I started work as a public defender.

The people I knew growing up, and now the people I fight for in court, are also victims of gun violence themselves.

NPR Public Radio in Kansas City: Gun Owners Are Racists

Sat, 03/12/2022 - 13:00

In a shameful piece of race-baiting bigotry, NPR radio in Kansas City touted a study conducted by an associate professor of political science. In it, Professor Don Haider-Markel (he/him/his) completely ignores the racist roots of gun control laws to instead claim that it’s gun owners who are racists, not the politicians who support racist, classist, and sexist gun control.

The junk-science professor conducted a study that purports to show that gun owners became less inclined to support freedom and gun rights for all when shown a picture of a “dark-skinned” person pointing a gun at them.

Charges Dropped Against Security Guard Who Shot Protestor In October, 2020

Sat, 03/12/2022 - 10:00

Protests escalating into violent situations were all the rage in 2020, and unfortunately there was no shortage of related deaths. On the self-defense side of the scales, the most visible incident was that of Kyle Rittenhouse, of course. But the shooting of aggressive protestor Lee Keltner by security guard Matthew Dolloff certainly made waves in the news when it happened.

Looks like Denver prosecutors have [finally] decided this was such a clear-cut case of self-defense that they’re dropping all charges.
